Terms of Service

1. Introduction
These Terms govern your access to and use of arcops, including our website, workspace, tracking script, analytics, API, CLI, MCP server, events, webhooks, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization.
2. Your Services Provider
The Services are provided by Arco Labs LLC, a Wyoming limited liability company (“Arco Labs,” “we,” “us,” or “our”). Our contact details are 30 N Gould St Ste R, Sheridan, WY 82801, USA and [email protected].
3. Eligibility and authority
You must be legally able to enter a contract where you live. The Services are intended for business and professional use. You may not use the Services if doing so is prohibited by applicable law, export controls, or sanctions. If you invite teammates, you are responsible for making sure they are authorized to access your organization and its data.
4. Accounts, workspaces, and API keys
You must provide accurate account information and keep login credentials, workspace invitations, and API keys confidential. You are responsible for activity under your account and for promptly revoking credentials that may be compromised. A workspace controls its sites, integrations, analytics, inbox records, agent history, audit records, and organization-scoped API keys. Removing one person's membership does not transfer ownership of workspace data or delete it.
5. The Services
Arcops provides a data, Agent, and controlled-action layer for founder-led growth. Depending on your configuration, the Services can collect product events, connect acquisition and billing facts, model product users and accounts, define lifecycle milestones, record experiments and releases, surface durable signals, and expose those facts through the workspace, API, CLI, MCP, events, or webhooks.
Arcops may use a bounded Agent runtime to inspect connected evidence, form hypotheses, prepare code changes, and report outcomes. Agent output can be incomplete or wrong. Coding, merge, publish, and other consequential actions remain subject to the scopes and approval gates shown in the Product. You remain responsible for those approvals and for actions taken through connected systems.
6. Your data and responsibilities
You retain ownership of data, content, events, messages, and configuration that you submit to or collect through the Services (“Your Data”). You grant Arco Labs the limited rights needed to host, process, secure, display, transmit, and back up Your Data to provide the Services. We may use aggregated or de-identified operational information to operate, secure, and improve the Services.
You are responsible for the lawfulness, accuracy, and permissions behind Your Data. If you install the tracker or send identity, event, inbox, Stripe, or Search Console data, you must provide all notices and obtain all consents required by applicable law and by the terms of the connected provider. Do not send secrets, sensitive personal information, or data you are not authorized to process.
7. Third-party accounts and integrations
You may connect Stripe, Google Search Console, Cloudflare, Google sign-in, email, and other third-party systems. Those systems are governed by their own terms and privacy policies. You authorize us to access only the scopes and credentials you configure, and you may disconnect an integration at any time. We are not responsible for a third party's availability, data quality, changes, or acts. A connected provider may limit or revoke access without notice.
8. Agent actions and acceptable use
You must review scopes and approvals before allowing an agent to write data, send an event, or call an external action. You may not:
- use the Services to violate law, privacy rights, or a third party's terms;
- access another organization, account, site, credential, or endpoint without authorization;
- send malware, destructive payloads, unlawful content, or data that creates an unreasonable security risk;
- probe, scan, reverse engineer, bypass rate limits, or interfere with the Services or another customer's use;
- use the Services to build a competing service from non-public information, resell access, or share credentials without our written permission; or
- use automated actions in a way that sends unsolicited messages or violates anti-spam, consumer-protection, or platform rules.
9. Pre-Checkout planning, trials, subscriptions, and billing
Your website analysis and initial evidence-backed opportunities may be available without charge. Planning does not automatically start a trial or paid subscription. You must separately authorize Stripe Checkout for a specific Website and provide a payment method.
The first Arcops Growth subscription for an eligible Website includes a seven-day trial of the complete subscribed service. Each Website may use the trial once. The subscription automatically becomes a $99 USD monthly subscription when the trial ends unless you cancel beforehand; cancellation during the trial prevents the first charge. After the trial, Arcops Growth renews automatically until canceled. It includes daily execution of one focused Build or Improve job at a time, subject to review and integration readiness. Taxes may be added where required. You can manage payment methods, invoices, and cancellation through the Stripe Customer Portal. After a paid period starts, cancellation takes effect at the end of the current paid period.
Except where law requires otherwise or we confirm a duplicate or erroneous charge, payments are non-refundable. A payment provider processes full payment-card details; we store only provider identifiers and subscription facts needed to operate the Services. If payment becomes past due, we may stop new coding Work while allowing already accepted Work to reach a safe stopping point. Product history and an available safety rollback are not disabled solely because a subscription ended.
10. Intellectual property
The Services, software, designs, documentation, trademarks, and other materials we provide are owned by Arco Labs or our licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business operations. No rights are granted by implication. Third-party and open-source components remain subject to their own licenses.
You may send feedback or suggestions. We may use them without restriction or compensation, provided we do not identify you or disclose Your Data as the source of the feedback.
11. Privacy
Our Privacy Policy explains how we collect and process information. It is part of these Terms. If you process personal data through the Services, you remain responsible for your role as controller or business and for any agreement or notice required with the people whose data you submit. Where applicable law requires, our Data Processing Addendum sets out the terms on which we process that data on your behalf.
12. Availability, data retention, and changes
We work to keep the Services available, but we do not promise uninterrupted or error-free operation. Maintenance, provider outages, network failures, security events, and changes in law can affect availability. Analytics and workspace records are generally retained while the workspace remains active. Search Console cache data is pruned after its documented retention window; raw Stripe webhook and outbound event payloads are pruned after 30 days, while limited delivery, audit, security, and transaction records may be retained for integrity, legal, and dispute purposes. We may change or discontinue a feature, with notice where reasonable.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create a security or legal risk, fail to pay an amount due, or if we discontinue the Services. We will use reasonable efforts to provide notice when it is safe and practical. On termination, your license ends and we may delete or de-identify data according to our retention practices and legal obligations. Deleting a personal login is separate from deleting an organization workspace; it does not silently delete workspace-owned operational history.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THAT THE SERVICES WILL PRODUCE A PARTICULAR GROWTH, REVENUE, SECURITY, OR BUSINESS RESULT. DATA FROM CONNECTED PROVIDERS MAY BE DELAYED, INCOMPLETE, OR INCORRECT. YOU MUST VALIDATE IMPORTANT RESULTS BEFORE ACTING.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCO LABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE EVENT OR (B) US$100. These limits do not apply where prohibited by law.
16. Indemnity
To the extent permitted by law, you will defend and indemnify Arco Labs and its affiliates, officers, employees, and licensors against claims, losses, liabilities, and expenses arising from Your Data, your use of the Services, your breach of these Terms, or your violation of law or a third party's rights.
17. Export controls and sanctions
You may not use or export the Services in violation of United States export laws or sanctions, or provide access to a person or country subject to a government embargo or restricted-party list.
18. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction, except where applicable law requires another forum.
19. Changes and miscellaneous
We may update these Terms as the Services change. We will post the revised version and update the effective date; material changes will receive reasonable additional notice. If a provision is unenforceable, the remaining provisions remain in effect. These Terms, the Privacy Policy, and any written order or agreement are the entire agreement about the Services and supersede prior statements on the same topic. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of the Services.
